Welcome to Unifydom! These Terms of Service ("Terms") govern your access to and use of the Unifydom website, services, and applications (collectively, the "Service") provided by Mon Agence Creative ("Mon Agence Creative," "we," "us," or "our"), doing business as UnifyDom.

By creating an account, clicking “I agree,” or using any part of the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and “you” as used in these Terms includes that organization.

• We provide portfolio tracking, estimates, and monitoring on an as-is, best-effort basis; you remain responsible for renewing your domains on time.
• We are not a registrar, host, or DNS provider and will not change your domain settings.
• If you exceed plan limits or misuse the Service, we may throttle, suspend, or terminate your account.
• Our liability is limited to the amount you paid us in the 12 months before a claim, and we exclude indirect damages to the extent permitted by law.

1. Acceptance of Terms

By creating an account, clicking “I agree,” or using any part of the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization; “you” includes that organization.

2. Changes to the Terms

We may update these Terms from time to time. We will notify you of material changes via the app or email. Your continued use of the Service after changes take effect constitutes your acceptance of the new terms. If you do not agree with the changes, you must stop using the Service.

3. The Service (What We Do and Don’t Do)

3.1 Features

UnifyDom helps you:

• Import domains (manually, via supported registrar connections, or via webmaster integrations) into a single dashboard.
• View estimated renewal costs and a month‑by‑month budget calendar.
• Monitor status signals (e.g., HTTP availability, SSL certificate status/expiry, basic DNS signals) and capture screenshots.
• Receive configurable alerts for deadlines or changes (e.g., renewal dates, SSL expiry, NS changes, downtime).

3.2 Read‑Only by Design

UnifyDom is not a registrar, host, DNS provider, or certificate authority. We do not transfer, register, renew, cancel, delegate, or otherwise change your domains or DNS settings. Any registrar actions (including auto‑renewal settings) must be done by you in your registrar account(s).

3.3 Estimates and Third‑Party Data

Renewal prices, TLD pricing, expiry dates, DNS/SSL data, screenshots, uptime signals, and similar information often come from third‑party sources and routine network checks. They may be delayed, incomplete, or inaccurate. All amounts displayed are estimates for planning only; the registrar’s price, taxes, and fees control.

3.4 Alerts Are Best‑Effort

Alerts (email, in‑app, or otherwise) are best‑effort and may be delayed, filtered, throttled, mis‑configured, or missed. You are solely responsible for tracking and renewing your domains on time.

3.5 Verification and Authority

We may ask you to verify control over a domain (e.g., by adding a DNS TXT record). You must only import or monitor domains you own or are authorized to manage. By connecting a registrar or webmaster integration, you authorize us to access the relevant read‑only data as your agent and to query your domains for the purposes of the Service.

4. Accounts and Security

You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your account. Notify us immediately of any unauthorized use. We may require re‑verification, impose security measures, or suspend access if we suspect misuse.

5. Plans, Limits, and Fair Use

5.1 Free and Paid Plans

We offer a free tier (e.g., up to 25 domains) and paid subscriptions with higher limits or features. Current plan details are shown in‑app. We may change plan features or limits as described in Section 2.

5.2 Processed vs. Unprocessed Domains

If you attempt to import more domains than your plan allows, we may add the excess as unprocessed (grayed‑out) entries that do not receive monitoring, alerts, or data refresh until you upgrade. Features such as screenshots, SSL and DNS monitoring, alerts, and scheduled refreshes apply only to processed domains within plan limits.

5.3 Refreshes, Throttling, and Rate Limits

To protect our infrastructure and third‑party services, we may apply smart polling, cooldowns, rate limits, and prioritization. Excessive manual refreshes, automation, or attempts to bypass limits may result in throttling or suspension.

5.4 Fair Use

You agree not to:

• Access or monitor domains you do not own or manage without authorization.
• Interfere with, overload, or degrade the Service or third‑party providers.
• Circumvent technical limitations, security controls, or plan limits.
• Use the Service to develop a competing product by scraping, bulk‑exporting, or reverse engineering.

6. Prohibited Conduct

You may not use the Service for any illegal, harmful, or abusive activity, including but not limited to: spam; denial‑of‑service; vulnerability scanning without authorization; infringing or defaming content; or violating others’ privacy or intellectual property rights. We may remove content, restrict access, throttle queries, or terminate accounts at our discretion.

7. Third‑Party Services and Integrations

Your use of third‑party services (e.g., registrars, webmaster tools, identity providers) is subject to their own terms and policies. We are not responsible for their actions, outages, or data accuracy. You are responsible for maintaining valid credentials, permissions, and payment methods with those providers. You may revoke our access at any time in those services; doing so may disable features in UnifyDom.

8. Payments, Billing, and Taxes

8.1 Subscriptions

Paid plans are billed in advance on a monthly or annual basis (as selected) and auto-renew until canceled. You authorize us and our payment processor to charge your payment method for all applicable fees, taxes, and overages (if any).

8.2 Changes, Upgrades, and Downgrades

Upgrades take effect immediately and may be prorated. Downgrades take effect at the next renewal. If you downgrade or cancel, features that exceed your new limits may become unavailable; excess domains may revert to unprocessed entries.

8.3 Refunds

Except where required by law or explicitly stated, fees are non‑refundable and non‑cancelable during the current term. Trial or promotional periods, if any, may be discontinued or changed at our discretion.

8.4 Taxes

Fees are exclusive of taxes. You are responsible for all taxes, duties, and governmental charges associated with your purchase, excluding our income taxes. Where required, we will collect and remit applicable taxes.

9. Intellectual Property; License to Use the Service

We and our licensors own the Service and all related IP. Subject to these Terms and your plan, we grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Service solely for your internal business purposes.

10. Your Content and License to Us

To operate the Service, you grant us a worldwide, non‑exclusive license to host, reproduce, analyze, and display: domain lists you import, settings, screenshots we capture on your request, and derived telemetry (e.g., uptime/SSL/DNS signals). You represent that you have the rights to provide this material and to authorize our use for the Service. You retain ownership of your content.

11. Privacy and Data Protection

Our Privacy Policy explains how we collect and process personal data (e.g., account information, telemetry, analytics). Where we act as a processor on your behalf, our Data Processing Addendum (DPA) will govern; a signed DPA is available upon request. You must obtain any consents and provide any notices required under applicable law for your use of the Service and integrations. You can review our Privacy Policy for more details.

12. Availability; Support; Beta Features

We strive to keep the Service available but do not guarantee uptime. Planned or emergency maintenance may occur. Support is provided as described in your plan. Features marked “beta,” “preview,” or similar are provided as‑is, may change, and may be withdrawn at any time.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE (INCLUDING ALL MONITORING, ESTIMATES, ALERTS, SCREENSHOTS, AND INTEGRATIONS) IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. ESTIMATES AND ALERTS ARE FOR CONVENIENCE ONLY AND MAY BE WRONG OR DELAYED. YOU ALONE ARE RESPONSIBLE FOR RENEWING YOUR DOMAINS ON TIME.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL; AND (B) OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

Some jurisdictions do not allow certain exclusions or limitations; in that case, the exclusions/limitations apply to the fullest extent permitted by law.

15. Indemnification

You will defend, indemnify, and hold harmless Mon Agence Creative, its affiliates, and their officers, directors, employees, and agents from and against any claims, losses, and expenses (including reasonable attorneys’ fees) arising from or relating to: (a) your content; (b) your use of the Service in violation of these Terms or applicable law; or (c) your use of third‑party services and integrations.

16. Suspension and Termination

We may suspend or terminate your access immediately if: (i) you breach these Terms or applicable law; (ii) your use risks security, legal exposure, or service disruption; (iii) fees are past due; or (iv) we discontinue the Service. You may terminate at any time via the app; termination does not entitle you to a refund unless required by law. Upon termination, your license ends and we may delete or anonymize your content after a reasonable period, subject to legal obligations.

17. Compliance; Export; Sanctions

You must comply with all applicable laws, including export control and sanctions laws. You represent that you are not on any restricted list and will not use the Service in prohibited jurisdictions.

18. Notices; Electronic Communications

We may send you notices via email, in‑app messages, or postings in the Service. You consent to receive communications electronically and agree that they satisfy any legal requirements for written communications.

19. Governing Law; Venue

These Terms are governed by the laws of France, without regard to its conflict of laws rules. The courts of Paris, France shall have exclusive jurisdiction over disputes, except that we may seek injunctive relief in any jurisdiction to protect our IP or the Service. If you are a consumer and mandatory laws of your habitual residence provide otherwise, those rights remain unaffected.

20. Miscellaneous

These Terms (and any referenced policies such as the Privacy Policy and DPA) are the entire agreement between you and us regarding the Service and supersede prior agreements. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. If any provision is unenforceable, it will be modified to the minimum extent necessary or severed; the remainder will remain in effect. No waiver is effective unless in writing and signed by us.

Annex A — Service‑Specific Rules and Acknowledgements

1. 1. Domain Monitoring Authority. You confirm you own or control each domain you add. You authorize us to query those domains (e.g., HTTP/HTTPS requests, TLS handshake, basic DNS queries) to provide the Service.
2. 2. Registrar Connections. Where supported, you may connect registrar accounts via OAuth, API keys, or similar. We use those credentials solely to read data necessary to provide the Service and store them securely. You can revoke credentials at any time; doing so may disable features.
3. 3. Screenshots and Caching. You authorize us to render and store screenshots and related artifacts for your domains. You are responsible for ensuring that capturing and storing such content complies with your obligations to third parties. We may delete cached assets at any time.
4. 4. DNS/SSL Data. DNS records and certificate data can be stale, overridden, or hidden by upstream providers. We do not guarantee their accuracy.
5. 5. Alerts Configuration. You control thresholds and destinations. Misconfiguration may prevent delivery. Anti‑spam filters and third‑party outages can also block delivery.
6. 6. Programmatic Abuse. Automated scraping of the Service, mass export of data beyond provided export features, or using the Service to monitor domains without authorization is prohibited and may lead to immediate suspension.
7. 7. Branding and Attribution. You may not remove or obscure UnifyDom/Mon Agence Creative branding in the UI unless expressly permitted in your plan.
8. 8. Feedback. If you send feedback or suggestions, we may use them without restriction or compensation.
